Claim maximum legal tax deductions on rental income in Pakistan under Section 15A. 20% repair allowance, mortgage interest, property tax, and unpaid rent write-offs.

[Tax Year 2027 Statutory Directive]: Under Section 15A of the Income Tax Ordinance, 2001 (re-enacted through Finance Acts to eliminate the separate block property regime), individual, AOP, and corporate landlords in Pakistan are entitled to deduct legitimate operational expenses from gross rent. While most property owners only know of the unconditional 20% statutory repair allowance, Section 15A authorizes nine distinct statutory deductions—including mortgage profit on debt, municipal property taxes, insurance premiums, legal defense costs, and bad rent write-offs.
[Tax Year 2026 Framework]
- Updated for FY 2026 compliance.
- Reflects current FBR and SECP statutory requirements.
A significant proportion of landlords in Pakistan overpay their federal income taxes simply because they fail to claim the full slate of statutory deductions authorized under Section 15A of the Income Tax Ordinance, 2001.
Following historical legislative shifts that transitioned property income from a separate block gross taxation regime back into the net income progressive regime, taxpayers have the legal right to subtract comprehensive operational expenses incurred in generating rental revenue. Claiming these statutory deductions legally slashes taxable income, prevents bracket creep, and protects asset profitability.
Section 15A(1) enumerates the exhaustive list of expenditures and allowances deductible from gross rental income in computing net taxable income under the head Income from Property:
┌─────────────────────────────────────────────────────────────────────────┐
│ SECTION 15A STATUTORY DEDUCTION INVENTORY │ └─────────────────────────────────────────────────────────────────────────┘ │ ├─► 1. Section 15A(1)(a): 20% Statutory Repair Allowance (Unconditional) │ ├─► 2. Section 15A(1)(b): Property Insurance Premiums (Damage/Destruction) │ ├─► 3. Section 15A(1)(c): Local Rates, Taxes & Provincial Property Tax │ ├─► 4. Section 15A(1)(d): Ground Rent Paid on Leasehold Land │ ├─► 5. Section 15A(1)(e): Profit on Debt / Bank Mortgage Interest │ ├─► 6. Section 15A(1)(f): Depreciation on Plant & Machinery (Rented with Building) │ ├─► 7. Section 15A(1)(h): Rent Collection Charges (Up to 6% of Rent) │ ├─► 8. Section 15A(1)(i): Legal Expenditures to Defend Title or Evict Tenants │ └─► 9. Section 15A(1)(j): Unpaid Rent / Defaulting Tenant Bad Debt Write-Off
The repair allowance is the most powerful deduction available to Pakistani landlords:
"an allowance equal to one-fifth of the rent chargeable to tax in respect of the property, computed without regard to this clause, in respect of the repair of the property."
Key statutory features of the repair allowance:
Repair Allowance Mathematical Rule:
Gross Rent Received or Receivable: PKR 10,000,000 Mandatory 20% Statutory Repair (1/5): (PKR 2,000,000) Taxable Rental Base (Before other deductions): PKR 8,000,000
Taxpayers who pay Urban Immovable Property Tax (UIPT) to provincial authorities—such as the Punjab Excise, Taxation and Narcotics Control Department or Sindh Excise—can deduct every single rupee paid:
"any local rate, tax, charge or cess in respect of the property paid or payable by the person to any local authority or government in the year, not being any tax payable under this Ordinance."
This provision settles the long-standing street confusion: provincial excise tax is not a final income tax liability, but it is an allowable deduction that directly reduces your federal taxable income. Cantonment Board property taxes, municipal conservancy cesses, and development authority charges also qualify under this clause.
If a landlord borrows capital from a commercial bank (e.g., conventional mortgage or Islamic Diminishing Musharakah / Murabaha financing) to purchase, construct, or reconstruct the rented property, the financing cost is fully deductible:
"any profit paid or payable by the person in the year on any money borrowed by the person to acquire, construct, renovate or reconstruct the property."
This deduction is critical for leveraged real estate investors. If a commercial building generates PKR 12,000,000 in gross annual rent, but the landlord pays PKR 7,000,000 in bank mortgage profit on debt during the same tax year, that PKR 7,000,000 is subtracted directly from rental revenue, dramatically slashing net tax liability.
Landlords who employ property management agencies, estate managers, caretakers, or billing staff can deduct operational collection expenditures:
Legal fees paid to advocates to defend the landlord's title to the property or to institute eviction proceedings against defaulting tenants are fully deductible under Section 15A(1)(i).
One of the most valuable yet strictly scrutinized deductions is the write-off for unpaid rent resulting from defaulting or absconding tenants. Under Section 15A(1)(j), a landlord can deduct unpaid rent if and only if all three of the following statutory conditions are fulfilled:
┌─────────────────────────────────────────────────────────────────────────┐
│ SECTION 15A(1)(j) UNPAID RENT STATUTORY TEST │ └─────────────────────────────────────────────────────────────────────────┘ │ ┌───────────────────────────┼───────────────────────────┐ ▼ ▼ ▼ [Prong 1: Tenancy] [Prong 2: Vacation] [Prong 3: Legal Action] │ │ │ The tenancy was bona fide; The defaulting tenant Landlord has instituted income was previously has vacated the property legal proceedings for declared or paid in prior or reasonable steps were recovery, or has proof tax years. taken to compel eviction. that proceedings would be futile.
If a tenant defaults on PKR 3,000,000 of rent and vacates without paying, you cannot simply write off the amount without legal documentation. You must demonstrate that an eviction suit or rent recovery petition was instituted under the Punjab Rented Premises Act, 2009 (or provincial equivalent), or provide a police report or judicial finding proving the tenant is untraceable or insolvent.
If a landlord claims a tax deduction for unpaid rent in Tax Year 2026, and unexpectedly recovers that outstanding rent from the tenant through a court settlement in Tax Year 2028:
FBR audit officers aggressively disallow improper deduction claims. The following expenses are strictly non-deductible under Section 15A:
Consider a commercial property owner in Islamabad who owns a multi-tenant commercial building:
STATUTORY TAX CALCULATION (TAX YEAR 2027):
Gross Rent Chargeable (Section 15) = PKR 24,000,000
Less Allowable Deductions under Section 15A:
- 20% Statutory Repair Allowance (Sec 15A(1)(a)) = (PKR 4,800,000)
- Bank Mortgage Profit on Debt (Sec 15A(1)(e)) = (PKR 8,000,000)
- CDA / Municipal Property Tax (Sec 15A(1)(c)) = (PKR 1,200,000)
- Property Insurance Premium (Sec 15A(1)(b)) = (PKR 300,000)
- Rent Collection Charges (Sec 15A(1)(h)) = (PKR 1,000,000)
- Legal Litigation Expenses (Sec 15A(1)(i)) = (PKR 500,000)
────────────────────────────────────────────────────────────────────────────
Total Allowable Deductions = (PKR 15,800,000) ──────────────────────────────────────────────────────────────────────────── Net Taxable Property Income (PKR 24,000,000 − 15,800,000) = PKR 8,200,000
By fully utilizing Section 15A, the taxpayer legally reduces their taxable income from PKR 24,000,000 down to PKR 8,200,000, saving millions in progressive income tax.

### TaxCalc Advisory Insights: Record-Keeping Defense
"The 20% statutory repair allowance is virtually untouchable because Parliament made it unconditional. However, every other deduction under Section 15A is vulnerable to disallowance during a Section 177 tax audit if you do not possess documentary receipts.
> For mortgage interest, obtain a formal Bank Tax Certificate explicitly citing your CNIC/NTN, facility account number, and interest paid during the exact fiscal year. For property taxes, preserve original Excise payment challans stamped by the National Bank of Pakistan. If an auditor issues an audit observation letter, having this substantiation folder on hand prevents costly tax demand notices and penalty proceedings."
